These terms and conditions, as may be amended from time to time, apply to all our services made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our (mobile) website or any of our applications through whatever platform (hereafter collectively referred to as the “Platform”) and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).


These pages, the content and infrastructure of these pages, and the online reservation service provided by us on these pages and through the website are owned, operated and provided by Verticelegante, Unipessoal Lda and are provided for your personal, non-commercial (B2C) use only, subject to the terms and conditions set out below. The Payment Service is provided by Paypal and subject to their own Terms and Conditions available in https://www.paypal.com/pt/webapps/mpp/ua/legalhub-full



“Soudade.pt”, “us”, “we” or “our” means Verticelegante, Unipessoal Lda, a limited liability company incorporated under the laws of Portugal, and having its registered address at Travessa dos Estorninhos, 48, 2925-002 Azeitão , Portugal.  “Platform” means the (mobile) website and app on which the Trip Service is made available owned, controlled, managed, maintained and/or hosted by Soudade.pt. “Trip” means the various different travel products and services that can be ordered, acquired, purchased, bought, paid, rented, provided, reserved, combined or consummated by you from us.


“Trip Service” means the online purchase, order, (facilitated) payment or reservation service as offered or enabled by Soudade.pt in respect of various products and services as from time to time made available by the Platform.


“Trip Reservation” means the order, purchase, payment, booking or reservation of a Trip or stay in our apartments.


  1. Scope and nature of our Service


Through the Platform, we can advertise, market, promote and/or offer (as applicable) our products and service for order, purchase, reservation, hire, and through which relevant visitors of the Platform can discover, search, compare, and make an order, reservation, purchase or payment (i.e. the Trip Service). By using or utilizing the Trip Service (e.g. by making a Trip Reservation through the Trip Service), you enter into a direct (legally binding) contractual relationship with us.


When rendering our Trip Service, we are responsible for updating all rates/fees/prices, availability, policies & conditions and other relevant information which is displayed on our Platform. Although we endeavour to be as much accurate as possible in performing our Trip Service we cannot guarantee that all information is 100% accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information.


Our Trip Service is made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, reservations, tickets, products or services available on our Platform for any commercial or competitive activity or purpose.

  1. Credit card


Soudade.pt offers the opportunity for Trip Reservations to be paid in full during the Trip Reservation process by means of secure online payment provided Paypal, which will safely process the transfer from your credit/debit card, paypal account or bank account, to our bank account or Paypal account.


  1. Bank Transfer


Bank transfer is also available at request and after agreeing the terms, period and amount, between the parties. This however is not possible to do using our platform, only inquiring via email. Please send us an email to ola@soudade.pt stating the period and the apartment you want to reserve and we will return to you with the details and availability.


  1. Pre-payment, cancellation and no-show


By making a Trip Reservation with us, you accept and agree to our cancellation and no-show policy which is as follows:


  1. Pre-Payment is mandatory to all reservations made in the Platform via Paypal or made by Bank Transfer.
  2. You may cancel free of charge until 30 days before arrival. You will be charged the total price if you cancel in the 30 days before arrival.


During the reservation procedure a confirmation email is sent, please use the contacts available to inform if you wish to cancel. The refund will be made via Paypal or Bank Transfer according to what was used in the initial payment.


If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to (timely/promptly) communicate this to us so we know when to expect you to avoid cancellation of your reservation or room or charge of the no-show fee. By default house rules applies regarding check-in, check-out and house policies,  please check each house page to know the full details.


  1. (Further) correspondence and communication


By completing a booking, you agree to receive (i) an email stating a reservation was made, (ii) an email stating the payment was complete, (iii) an email which we may send you shortly prior to your arrival date, giving you information on your destination and providing you with certain information and offers (including third party offers to the extent that you have actively opted in for this information) relevant to your reservation and destination, and (iv) an email which we may send to you promptly after your stay inviting you to complete our guest review form. Please see our privacy and cookies policy for more information about how we may contact you.


In order to duly complete and secure your reservation, you need to use your correct email address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled email address or inaccurate or wrong (mobile) phone number or credit card number.


Any claim or complaint against Soudade.pt must be promptly submitted, but in any event within 30 days after the scheduled day of consummation of the product or service (e.g. check out date). Any claim or complaint that is submitted after the 30 days period, may be rejected and the claimant shall forfeit its right to any (damage or cost) compensation.


Due to the continuous update and adjustments of rates and availability, we strongly suggest to make screenshots when making a reservation to support your position (if needed).


  1. Disclaimer


Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).


However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) as made available on our Platform, (iii) the services rendered or the products offered by us, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Platform, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to us or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.


Soudade.pt is not responsible (and disclaims any liability) for the use, validity, quality, suitability, fitness and due disclosure of the Trip and makes no representations, warranties or conditions of any kind in this respect, whether implied, statutory or otherwise, including any implied warranties of merchantability, title, non-infringement or fitness for a particular purpose. You acknowledge and agree that the customer is the solely responsible and assume all responsibility and liability in respect of the Trip.


  1. Intellectual property rights


Unless stated otherwise, the software required for our services or available at or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are owned by Soudade.pt.


Soudade.pt exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the Platform on which the service is made and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content or our brand without our express written permission.


  1. Miscellaneous


To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Portuguese law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in Setubal, Portugal.


The original Portuguese version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and office translation only and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these terms and conditions or inconsistency or discrepancy between the Portuguese version and any other language version of these terms and conditions, the Portuguese language version to the extent permitted by law shall apply, prevail and be conclusive. The Portuguese version is available on our Platform (by selecting the Portuguese language) or shall be sent to you upon your written request.


If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.

2. What data we collect and what we do with your data
a. Direct collection
As a visitor to the site, it is not necessary to provide any personal information to use the site www.soudade.pt.
The personal data of the users are collected only when an online reservation is made on the site www.soudade.pt, and so you can provide the information, clarification or reservation of accommodation requested.
The data we collect for these purposes are as follows:

• VAT Number *
• Information about the guest’s stay, including arrival and departure dates, special requests made, comments on service preferences *.
Data marked with a * are mandatory if you wish to make an online booking of accommodation.

B. Indirect collection of data:
The website www.soudade.pt, through Google Analytics, also collects the following aggregated data: Geographical origin (city, country), language, type of device, operating system, browser, operator, age, gender, date and time of access and addresses of the reference data, IP address. The site Soudade | Local Housing will monitor all statistical information regarding the use of the site in an aggregated and anonymous way. The data used for this purpose do not contain personal identification data or private information. Analysis made from aggregated statistical information will be made to interpret site usage patterns and continuously improve service levels and user satisfaction. The aggregate statistical information resulting from the analysis may be disclosed to third parties or publicly.
The site www.soudade.pt also uses cookies on the site to improve the performance and user experience.

The site www.soudade.pt collects your data to carry out the contract you have entered into with us. For example, if you use our services to make an online reservation, we will use your information to enforce our obligation to complete and administer this reservation in accordance with the agreement we enter into with you.

The site www.soudade.pt may also, if the data subject so authorizes, use the contact data provided for use in marketing campaigns or to send communications regarding our offer of services or our partners.
In such situations, the user is always given the possibility to oppose the sending of subsequent communications for the purposes of direct marketing, selecting the corresponding field or sending an email to geral@soudade.pt.

4. Data recipients
The data is addressed to the department responsible for executing the contract with us for the reservation of accommodation.

5. How long and where do we store your data
The website www.soudade.pt will proceed to the storage and maintenance of the data up to: instructions of the user to the contrary; that its maintenance is no longer permitted by law; to the date on which the site www.soudade.pt no longer has a valid basis for the treatment of your data.

6. Disclosure of data
The website www.soudade.pt does not disclose the collected personal data, unless required by law or by the competent authorities.

7. Transfers to third countries
There are no transfers of data to third countries.

8. What measures have we implemented to protect your data against unauthorized access, alteration or destruction?
The site www.soudade.pt takes the necessary and legally required precautions to guarantee the protection of the information collected from its users through the site www.soudade.pt
These precautions guarantee the offline security of this information. Among others, the following technical and organizational measures are implemented to guarantee the security and confidentiality of personal data: physical security (through access control), logical separation of registers, access passwords and access levels, firewalls and antivirus programs.
The data is kept encrypted.

9. Your rights
All personal data are processed in accordance with the provisions of Law 67/98 of 26 October and Regulation 2016/679 of the European Parliament and of the Council, with the holders of personal data having the right to access, freely, and without restrictions, confirming, rectifying, deleting or blocking the data that they have provided, and can exercise it, personally in our facilities or in writing, by email geral@soudade.pt, at any time and without any charge. The Data Holder has the right to withdraw his / her consent at any time and must contact us by email geral@soudade.pt.
The data subject has the right to submit a complaint to the National Data Protection Commission or to any other supervisory authority.
